Who qualifies for a Section 504 plan?
A student may qualify for a specialized plan under Section 504 of the American Disabilities Act of 1973 if they have a physical or mental impairment that substantially limits a major life activity. Learning is a major life activity and students with disabilities are ensured equal access to their education under Section 504.
A student with a 504 plan has less procedural safeguards than a child who qualifies under IDEA/Special Education. Students that qualify for an IEP/Special Education qualify under Section 504, but not all students that qualify for Section 504 qualify for an IEP.
Typically, a 504 plan includes a list of accommodations and modifications that the student with a disability needs in order to access their education.
